Rules for the Management of Violations by Cainiao Merchants


I. Scope of application:
It is suitable for all AliExpress platform merchants (hereinafter referred to as "Merchant") that sign the Cainiao Service Standard Agreement (collectively referred to as "Cookie Service Agreement") with Hangzhou Cainiao Supply Chain Management Co., Ltd. and its affiliates (hereinafter referred to as "Cookie") and use Cainiao to provide various supply chain solutions.

II. Principles and Objectives
1. Principle: In order to create a better logistics environment, safeguard the legitimate rights and interests of the majority of merchants, and ensure the continuous provision of rookie service capabilities and the smooth flow of service links, rookies formulate the rules for the management of merchants' violations ("violation governance rules" or " These Rules).
2. Objective: To control the behavior of merchants in the use of rookie services, correct merchant violations, and deal with them in accordance with these rules.

III. Implementation and Procedures of the Rules
1. Source and judgment of information
Cainiao will comprehensively obtain clues to merchants' violations through, including but not limited to data investigation, merchant/consumer complaints, third-party reports, administrative departments' notices, and judicial documents, and based on the determination of national administrative departments and judicial organs, AliExpress platform will judge Or rookie judgment and other methods to determine whether the merchant's behavior has violated the regulations.
2. NoticeCainiao will notify the handling of merchants' violations, including but not limited to email, in-station announcements, in-station letters, DingTalk communication, telephone communication, SMS communication, etc. 3. Rescission of appeal and handling decisionIf the merchant disagrees with the handling measures taken by the rookie, he may appeal. The rookie will handle the merchant's complaint according to the specific situation.If the merchant initiates an appeal within the prescribed time limit, the rookie shall review and judge according to the content of the complaint. If the complaint is established, the violation shall be revoked; if the complaint is not filed within the time limit or the appeal is not established, the illegal handling shall be subject to the final determination of the rookie. At the same time, rookies will lift or partially lift violations according to the elimination of merchants' behavior, risks, etc.

IV. Types of violations and their disposals
Merchant violations are divided into serious violations and general violations.
1. Serious violations: refers to the serious violation of rookie's compliance business needs or suspected violations of relevant national/regional laws and regulations. Rookie will require merchants to rectify, fine, restrict/temporarily freeze the merchant's permission to obtain specific rookie services (such as creating logistics service orders and other functions), depending on the seriousness of the circumstances. Even measures such as permanent cessation of services (the above measures can be used alone or in parallel).
2. General violations: refers to violations other than serious violations. Rookies will take measures such as rectification, fines, return/destruction of packages according to the seriousness of the case.

Cainiao will charge the merchant a forward logistics forward distribution fee for the corresponding correct channel due to the merchant's error declaration and the rookie actively routeing the package, and the order processing fee will be charged at 6 yuan per order.The item of the order processing fee is named 'Dlush Processing Surcharge', which is charged together with the forward distribution fee when the first kilometer distribution center exits the warehouse.Cainiao has the right to require the merchant to bear the losses caused by the merchant's reasons. And for restricted goods, rookies have the right to take a series of measures, including but not limited to returning, notifying relevant government departments, handing them in, etc., in accordance with relevant laws and regulations and platform rules.
If the merchant does not approve the active routing results, he can initiate an appeal online (appeal type selection: fee problem - freight problem - fee dispute; appeal materials: provide the product link or commodity ID contained in the logistics order, physical picture of the product, and a detailed description of the reason for disapproval of the routing result). After the successful appeal, the "droulse processing surcharge" and the freight difference before and after the route can be refunded.

1. If the merchant sends prohibited goods, Cainiao has the right to take a series of measures including but not limited to returning, notifying relevant government departments, handing in or destroying the goods in the package in accordance with relevant laws and regulations and platform rules, and requiring the merchant to bear the losses of Cainiao/logistics caused by merchant reasons. 2. If the same goods sent by the merchant are seized for each of the embargoed goods, the cumulative number of seizures reaches 5, the rookie shall be paid a liquidated damages of RMB 500 (Note: the same commodity shall be calculated on the number of orders and packages generated under the same commodity ID; if the merchant sends highly similar prohibited goods through multiple commodity IDs, it shall also be regarded as It is the same commodity).
3. If the merchant violates any of the following embargo scenarios (including but not limited to the following scenarios), Cainiao will temporarily freeze the permission to create logistics orders, or even permanently close the permission to create logistics orders, stop services and other disposal measures.
1) Cainiao determines through data, manual and other means that the merchant's transaction order goods are prohibited goods (for specific prohibited goods, please click the shipping restrictions in each logistics plan to view);
2) Because merchants transport embargoed goods, they are investigated and punished by customs, which has a negative impact on rookies.
Processing of illegal goods associated logistics orders
Merchants' stores/commodities on AliExpress platform are punished by AliExpress platform for prohibited sales restrictions and intellectual property infringement.
Serious violations
Merchants have been punished for their stores and/or products released on AliExpress platforms for suspected prohibition of sales, intellectual property infringement, etc.
If the corresponding commodity information/commodity link or store as a whole is found by AliExpress platform to violate the prohibition of sales restrictions or intellectual property infringement according to its rules (click here to view the rules) sent by merchants, and is punished by AliExpress platform, Cainiao will have the right to rely on AliExpress. The platform determines the information of illegal goods/stores, and takes disposal measures such as closing the permission to create logistics orders and stopping services for logistics orders that have been generated but not created.

V. Management measures
1. Service permission control:
1) Temporarily block the permission to create logistics service orders: refers to temporarily blocking the permission of merchants to create logistics orders for transaction orders.
2) Close the permission to create logistics orders: refers to permanently closing the merchant's permission to create logistics orders for transaction orders, regardless of whether the transaction order has been generated.
3) Stop service: refers to the termination of the relevant Cainiao Service Agreement and the permanent suspension of providing all services agreed under the Cainiao Service Agreement to merchants. The rookie shall not be liable for any compensation to the merchant.
2. Disposal of illegal goods:
1) Package return refers to the return of the collected package to the merchant.
2) Parcel destruction refers to the destruction of collected parcels in accordance with the requirements and specifications of designated departments.
3. Related impact:
1) The merchant shall be liable for the losses caused by its breach of contract, including but not limited to the disposal expenses agreed under these rules, losses caused by rookies and logistics providers, etc.

VI. Supplementary Provisions
1. These rules will take effect for the first time on April 1, 2021 and will be amended on October 8, 2021.
2. Rookies reserve the right to update and adjust these rules from time to time, and issue and add individual rules
