Penalties for Document Fraud 

 

1. Scope

Alibaba.com is committed to the good faith protection of users' legitimate rights and interests. To create a fair and just marketplace and to maintain its healthy and orderly growth, Alibaba.com will handle any document fraud (provision of fake certificates) by its members or reports of such fraud from its members, once verified, in strict accordance with the following rules (hereinafter referred to as "these Rules").

II. Definition

Document fraud in this document refers to members' provision of forged or altered certificates to Alibaba.com.

 

III. Document Fraud

A member shall be deemed to have committed document fraud if he/she provides fake certificates during registration, business operation, transaction, rights infringement appeal, and submission of evidence for dispute resolution, including but not limited to:

- Business certification fraud (e.g. provision of fake business licenses and fake certifications related to production and operation such as those of offices, plants, production lines, etc.);

- Brand certification fraud (e.g. provision of fake brand authorization documents or fake brand trademark registration certificates);

- Special industry business license fraud (e.g. provision of fake medical device manufacturing licenses or fake medical device business licenses);

- Logistics document fraud;

- Falsification of contracts and invoices; and

- Falsification of other documents

 

IV. Violation Handling

A total of 12 points will be deducted for each mild violation.

If the document fraud is serious, or causes significant losses to the platform, including but not limited to economic loss and reputation loss, the platform will close the violator's account.

Moreover, violators will be subject to the platform's temporary market control measures according to the severity of the violation. If a member obtains improper benefits by providing fake certificates, the member shall immediately stop using or return the improper benefits. If any losses are caused to Alibaba.com, the member shall also indemnify the platform for such losses.

The above rules shall apply, unless otherwise provided in other rules of the platform.

V. Identification of Fake Certificates

1. Certificates are inconsistent with those published by state administrative bodies, judicial authorities, and other relevant departments and institutions, or are proved to be false by such organizations.

2. Certificates are proved to be forged or altered upon the platform's verification, e.g. false invoices.

3. Based on the reasonable suspicion of document fraud, the platform will notify involved members that they shall provide additional proof that can validate the accuracy, authenticity and legitimacy of suspicious certificates or provide an explanation. If such members fail to provide any proof or make any reasonable explanation within the reasonable period specified by the platform, such certificates will be deemed "fake certificates".

4. Certificates are proved to be false by their issuers.

5. Members admit that the certificates they provide are false.

6. Certificates are proved to be false by other valid evidence.

 

VI. Miscellaneous

1. Alibaba.com has the right to promptly revise and announce these Rules in accordance with the adjustment to laws and regulations, changes in the business environment, and other factors. The revised rules shall take effect upon the expiration of the period in which they are announced for public comments.

2. These Rules are an integral part of the rules issued by Alibaba.com. If these Rules are inconsistent with other rules issued by Alibaba.com, these Rules shall prevail. Matters that are not covered herein shall be subject to other rules issued by Alibaba.com.
