The digital dream is slowly turning into a nightmare....

 

Pursuant to the “Notice regarding Medical Devices That Must Meet the Qualification Requirements in the Destination Country", users of Alibaba.com should not sell any medical device products to countries/regions where the product does not fulfill all the relevant compliance requirements of those countries/regions or has not received all the relevant approvals of the relevant authorities of those countries/regions. For instance, medical device products on Alibaba.com may only be listed for sale or sold to the US if the sale is made in full compliance with all United States Food and Drug Administration (U.S. FDA) requirements and any other applicable laws, regulations or requirements, including but not limited to the approvals and/or registrations that are required to be obtained before such medical device products can be sold into the US. 

 

To improve the management of the pre-listing approval process, Alibaba.com has recently upgraded its product qualification checking tools. The system now requires sellers to provide the government issued medical device number applicable for all destination countries. For example, if a seller seeks to list or sell a medical device product to the US via Alibaba.com, and the product falls within the FDA’s regulatory regime, the seller must first upload the product’s FDA registration number and FDA product code to the system. The seller will only be permitted to list the medical device product for sale on the platform after the platform confirms that the seller has uploaded all of the required qualification documents/information. The approval process will generally take less than five (5) business days. Please see the following table to gain an understanding of the changes made to the information required to be uploaded.

Additional remarks: In the event that a seller registers multiple FDA Product Codes with the FDA, the seller will need to upload each FDA Product Code to the platform separately. In other words, the system will only accept one product code at any one time. 

 

When listing or selling products on Alibaba.com, sellers must comply with the applicable laws and regulations of all applicable countries/regions. The platform will periodically conduct random checks to confirm that sellers have fulfilled all relevant compliance requirements for listing and selling medical device products in any destination countries. Alibaba.com reminds sellers that they may be held criminally liable by the destination countries for the sale of non-compliant, unapproved or unauthorized medical device products to those destination countries. Sellers may also face penalties, including but not limited to heavy fines, product detainment and forfeiture of goods. 

 

In the event that a seller circumvents the platform rules and attempts to/successfully sells non-compliant medical device products to destination countries via the platform, Alibaba.com may impose upon the seller penalties including but not limited to removing the non-compliant product from the platform, deduction of points, blocking the product listing from being viewed and/or sold to certain countries/jurisdictions, or terminating the seller’s account. Alibaba.com will be entitled to impose such penalties regardless of whether the product was non-compliant on the basis of failing to meet the applicable requirements of destination countries or non-compliant on the basis that the pre-listing approvals have been rejected. Sellers on Alibaba.com are requested to actively cooperate with relevant compliance efforts. 

This notice will take effect on May 13, 2022. We will continue to follow relevant policy changes and adjust the platform control policies accordingly.
